The following provisions set out the general terms and conditions of sale:

Hereinafter referred to as "the Client

The Customer declares and guarantees to be of legal age and to act as a final consumer of the products he/she purchases or orders.

Object

The company informs the Customer that the following are subject to the General Terms and Conditions of Sale:

All orders placed on the website wwww.erromaroquinerie.fr
All purchases made in Erro stores

The Customer is informed of the availability of the General Sales Conditions on the website www.erro-maroquinerie.fr and on request, in Erro's store. These are likely to be the subject of modifications and updates. The conditions applicable to the order or the purchase of a product by a customer are those in force at the day of the order.

The Customer declares to have read the present GTC and all the information listed in article L. 221-5 of the Consumer Code, and to have accepted the said information as well as the GTC, at the time of purchase.

I) The client

Before ordering on the site, the Customer must create a customer account. To this end, he/she must fill in the dedicated form in the "My Account" section with information about him/her, and the Customer thus undertakes to provide accurate information and not to impersonate a third party or to change his/her age.

In particular, the Customer shall indicate his personal e-mail address and a password (comprising at least 10 characters and complying with the requirements) which will be used to identify himself on the site later. The login and password are personal and the Customer undertakes to keep them and not to disclose them.

The Customer acknowledges having the capacity required to contract and acquire the products offered on the site. The Customer acknowledges being of legal age at the time of purchase and acting for personal purposes.

The fact of placing an order implies the whole preliminary adhesion, and without reserve, with the CGV by the Customer by clicking on the button "I read and I accept the general conditions of sale.

2) The Company

The company BORDAGAIN SAS declares to be the owner of ERRO products, it certifies the accuracy of the information provided on its website www.erro-maroquinerie.com and in ERRO stores.

3 ) Products

The company BORDAGAIN SAS offers for sale leather goods.

The products offered for sale appear on the site within the limits of their availability, and the offers remain valid as long as they are visible on the site or for the duration indicated in the corresponding promotion.

The company BORDAGAIN SAS reserves the right, at any time, to withdraw any product on sale on the site.

In case of unavailability of a product after validation of the order, the Customer is quickly informed by email and the missing product(s) is (are) automatically cancelled and refunded.

The descriptions of the products on sale on the site are given as an indication. Similarly, the photographs do not constitute any contractual commitment and may differ slightly from reality (colors, materials, etc.), particularly due to the configuration of the display parameters of the interface used.

In accordance with Article L. 111-1 of the Consumer Code, information on the characteristics of products, are described precisely and illustrated with photos and data sheets on the site e-Commerce erro-maroquinerie.com

Technical information on the products sold in the ERRO Shop is available upon request by the Customer.

4) Ordering

Orders can be placed on the website www.erro-maroquinerie.com

The contractual information is presented in French and will be confirmed at the latest at the time of validation of the order.

The customer accepts the terms of the present contract at the time of his purchase. He is informed that the fact of placing order, obliges him to pay the amount due.

The company BORDAGAIN SAS informs the customer, in acknowledgement of receipt, without delay and by electronic means, the taking into account of its order and the deadline for receipt of the product. In the absence of indication of this date or of this delay or in the absence of agreement between the parts, the Company makes a commitment to deliver the good without unjustified delay and at the latest thirty days after the conclusion of the contract (article L. 216-1 of the Consumer Code).

The company BORDAGAIN SAS reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in case of supply problem, difficulty concerning the order received, dispute over payment or doubt about the purpose of use of the Products.

5) Delivery

Bordagain commits itself to send the order within 48 hours (working days). The delivery will be made in France by UPS within 4 to 5 working days.

The products are shipped to the delivery address indicated by the customer when ordering. In case of change of address, it is up to the customer to notify it before placing the order.

The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times. In order for these times to be respected, the customer must ensure that he/she has provided accurate and complete information concerning the delivery address, in particular the street number, building number, staircase number, access codes, name and number of the intercom, name of the lane, postal code, city.

In the event of failure to deliver on the date or within the period stipulated or, in the absence thereof, within thirty days of the conclusion of the contract, the Client may request, in writing, that the Company make the delivery within a reasonable additional period. If the Company did not carry out in this new delay, the customer will be able to ask, by a writing, the resolution of the contract. (article L. 216-6 of the Code of the consumption). The contract is considered as solved in reception by the professional of this mail, unless this one did not execute meanwhile.

The customer is informed that he can immediately cancel the contract (without prior writing) whenthe non-delivery is due to an obvious refusal of the professional to deliver the product

6) Shop

Purchases can be made in the ERRO store, located on Avenue Prince de Galles, quartier LAROCHEFOUCAULD, résidence BEL VIA, Bâtiment B, 64600 Anglet, France.

7) Prices

The Company BORDAGAIN SAS markets its products in metropolitan France.

In accordance with Article L.112-1 of the Consumer Code, the price information is expressed in euros, including all taxes. The value added tax is the one in force on the French metropolitan territory on the day of the validation of the order. The price is expressed without processing and delivery costs. Shipping costs are at the expense of the Customer, unless otherwise stated or specific conditions.

The company BORDAGAIN SAS reserves the right to change its prices at any time. The Product will be invoiced on the basis of the price in force at the time of the validation of the order and subject to availability.

In case of display of an erroneous price, obviously derisory, whatever the reason (computer bug, manual error, technical error.), the order -even validated by the Company- will be cancelled. The Customer will be informed as soon as possible and will be able, if he/she wishes, to place another order at the correct price.

The products remain the property of the company BORDAGAIN SAS until full payment of the price.

8) The product

The company BORDAGAIN SAS offers for sale leather goods.

Technical information on the products sold in the ERRO Shop is available upon request by the Customer.

9) Warranty

The present guarantees are applicable in accordance with the Code of consumption, on the site www.erro-marroquinerie.com and the ERRO store located in Anglet.

Legal guarantee of conformity

In accordance with Article L.217-43 to L.217-17 of the Consumer Code, the company BORDAGAIN SAS is required to deliver a good in conformity with the contract and is responsible for defects in conformity existing at the time of delivery or the act of purchase in the store.

Legal guarantee against hidden defects

The company BORDAGAIN SAS is bound by the guarantee for hidden defects of the thing sold that make it unsuitable for the purpose for which it was intended, or that reduce its use so much that the buyer would not have acquired or would have given a lower price if he had known (article 1641 and following of the Civil Code).

Commercial warranty

The company BORDAGAIN SAS undertakes to take back, refund, exchange or repair any product sold on the site that does not conform to the condition or proper use described in the product sheet in accordance with Article L.211-2 of the Consumer Code. In the same way, the possible defects which would be revealed after purchase will be the object of resumption, exchange or repair by the company.

The action in guarantee of conformity is prescribed by 2 years as from the delivery of the good. A good is in conformity, according to article L.217-5, when it is either fit for the use usually expected of a similar good, if applicable:

that it corresponds to the description of the salesman and has the qualities presented in sample or model;
that it has the qualities that a consumer can legitimately expect following the public declarations of the seller, producer or representative (advertising, labeling, etc.). The declarations of these last two professionals are not binding on the seller when the latter does not know them and is not in a legitimate position to know them.
has the characteristics defined by the parties or is fit for the special purpose intended by the buyer, known to the seller and accepted.

The Bordagain company guarantees the buckles of its products for life (buckles, bridles, saddle nails).

10) Payment

The Company informs the customer that the means of payment are specific to each point of sale. Thus, the payment methods accepted on the website www.erro-maroquinerie.com and the ERRO store may differ.

The customer is aware that the payment will be made when ordering and that the means of payment accepted by the company BORDAGAIN SAS on its e-commerce site are the following:

American Express; waiting for the banker to come back

The customer is aware that the payment will intervene at the time of the act of purchase in store and that the means of payments accepted by the company BORDAGAIN SAS in store ERRO are the following:

Checks are not accepted by the company BORDAGAIN SAS.

The 3 or 4x payment without fees can be done on the e-commerce site www.erro-maroquinerie.com and in Erro stores. This service is proposed by ONEY. ONEY is a partner of Erro Company, it is a payment solution in 3 or 4 times by Visa or MasterCard.
By paying in installments with ONEY, the customer accepts Oney's general customer conditions.

11) Right of withdrawal

Erro e-commerce website:

The consumer is informed prior to the conclusion of the contract of the existence of a right of withdrawal for this contract. In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from the date of receipt of the Order to exercise his or her right of withdrawal. The Customer may withdraw from the contract without giving any reason.

In accordance with the article L.221-5 of the Code of the Consumption, thecompany BORDAGAIN SAS informs the Customer of the methods of return on its Internet site www.erro-maroquinerie.com and in ERRO stores.

The product must be returned in its original packaging, new and unused. Any product used, worn or damaged, can not be returned to the company BORDAGAIN SAS.

12) Terms of return

For any modality of return the customer must inform the company BORDAGAIN SAS by mail with photos and explanations to the following mail address : bonjour@erro-maroquinerie.com.

If the return is accepted by BORGAGAIN SAS, a return label will be sent by e-mail. The product will then have to be dropped off at a UPS relay point within 7 days at the following address

The product must be returned in its original packaging, new and unused. Any product used, worn or damaged, can not be returned to the company BORDAGAIN SAS.

13) Modification of the present General Sales Conditions

BORDAGAIN SAS reserves the right to modify them at any time. The new general conditions of sale will be applicable only to orders placed after this modification.
